Segons l\u2019\u00faltim informe dels Registradors d\u2019Espanya, durant el primer trimestre de 2024 es van atorgar&nbsp;21.500 escriptures de compravenda a estrangers, un&nbsp;7,5 % m\u00e9s&nbsp;que en el trimestre anterior. Per aquest motiu, hem preparat aquesta&nbsp;guia pr\u00e0ctica&nbsp;amb els&nbsp;passos principals per comprar un immoble a Espanya, pensada especialment per a&nbsp;no residents que volen invertir. Contractar un advocat abans de comprar un immoble a Espanya<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Un cop trobada la propietat adequada, abans de signar qualsevol document o pagar qualsevol quantitat, \u00e9s molt recomanable<a href=\"https:\/\/maluquerabogados.com\/ca\/\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;comptar amb un advocat<\/a>&nbsp;independent. La seva funci\u00f3 \u00e9s fer una primera avaluaci\u00f3 legal de la propietat i assessorar-te sobre els acords que es signaran, per evitar sorpreses desagradables.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>2. Signatura de l\u2019acord de reserva<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">En alguns casos, per retirar la propietat del mercat durant un determinat per\u00edode de temps, es pot demanar al potencial comprador que signi un acord de reserva i pagui normalment entre\u00a03.000 euros i 10.000 euros\u00a0com a dip\u00f2sit. L\u2019import dependr\u00e0 del preu final al qual l\u2019immoble estigui ofert al mercat. Aquest per\u00edode de temps permetr\u00e0 al potencial comprador dur a terme les comprovacions legals oportunes. En general, els fons de la reserva es transfereixen a l\u2019ag\u00e8ncia immobili\u00e0ria encarregada de l\u2019operaci\u00f3 i es retornaran si sorgeixen problemes durant les comprovacions legals.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>3. Controls legals sobre la propietat<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Aquest \u00e9s un dels punts m\u00e9s importants del proc\u00e9s. Abans d\u2019avan\u00e7ar, conv\u00e9 verificar, entre d\u2019altres aspectes, els seg\u00fcents:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Qui \u00e9s el propietari<\/strong>: qui \u00e9s el propietari de l\u2019immoble. En cas de copropietat, cal que tots els copropietaris hagin expressat el seu consentiment per a la transacci\u00f3. Aquesta informaci\u00f3 es pot obtenir del Registre de la Propietat. Fins i tot si no hi ha copropietat, si el venedor est\u00e0 casat, cal verificar el r\u00e8gim matrimonial, ja que pot ser necessari el consentiment de l\u2019altre c\u00f2njuge.<\/li>\n\n\n\n<li><strong>Si existeixen c\u00e0rregues, hipoteques o grav\u00e0mens<\/strong>: comprovar si l\u2019immoble est\u00e0 lliure de c\u00e0rregues, hipoteques o grav\u00e0mens. Aquesta informaci\u00f3 tamb\u00e9 es pot obtenir del Registre de la Propietat. En cas que hi hagi una hipoteca sobre l\u2019immoble, el venedor ha de facilitar al possible comprador la documentaci\u00f3 relacionada amb la hipoteca.<\/li>\n\n\n\n<li><strong>Limitacions urban\u00edstiques i servituds<\/strong>: \u00e9s possible obtenir un certificat de l\u2019Ajuntament sobre l\u2019estat de la propietat, per\u00f2 aquest tr\u00e0mit pot trigar aproximadament un mes. En algunes ciutats, \u00e9s possible obtenir informaci\u00f3 urban\u00edstica b\u00e0sica a trav\u00e9s del web oficial de l\u2019Ajuntament. Si l\u2019immoble \u00e9s a prop del mar, tamb\u00e9 \u00e9s recomanable verificar si existeix alguna servitud sobre l\u2019immoble. Aquesta informaci\u00f3 es pot obtenir de l\u2019Ajuntament o de l\u2019Autoritat de Costes.<\/li>\n\n\n\n<li><strong>Certificat d\u2019habitabilitat<\/strong>: ha d\u2019estar vigent i acredita que l\u2019immoble compleix els requisits per ser habitat. El venedor est\u00e0 obligat a mostrar-lo.<\/li>\n\n\n\n<li><strong>Comunitat de propietaris<\/strong>: si l\u2019habitatge forma part d\u2019una comunitat, cal revisar l\u2019estat de pagament de les quotes. El venedor ha d\u2019aportar un certificat em\u00e8s per l\u2019administrador.<\/li>\n\n\n\n<li><strong>Que l\u2019immoble estigui lliure d\u2019ocupants<\/strong>.<\/li>\n\n\n\n<li><strong>IBI (Impost sobre B\u00e9ns Immobles)<\/strong>: \u00e9s important comprovar que estigui pagat, ja que, en cas contrari, el comprador n\u2019assumir\u00e0 el pagament.<\/li>\n\n\n\n<li><strong>Inspecci\u00f3 T\u00e8cnica obligat\u00f2ria<\/strong>: verificar si l\u2019immoble est\u00e0 subjecte a inspecci\u00f3 i si l\u2019ha revelat favorablement.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>4. Contracte d\u2019arres en comprar un immoble a Espanya<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Despr\u00e9s d\u2019haver realitzat amb \u00e8xit els controls legals corresponents, el seg\u00fcent pas \u00e9s signar un contracte d\u2019arres. En aquest contracte, el comprador i el venedor acorden els termes i les condicions de la venda, incl\u00f2s el preu de l\u2019immoble i el termini m\u00e0xim dins del qual s\u2019haur\u00e0 de signar l\u2019escriptura p\u00fablica de compravenda. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Normalment, el comprador paga entre un\u00a010 % i un 20 %\u00a0del preu de compra en concepte d\u2019arres, que es descomptar\u00e0 del preu total quan es formalitzi l\u2019escriptura p\u00fablica. En funci\u00f3 dels termes contractuals, pot donar-se el cas que, si el comprador decideix no continuar amb la compra,\u00a0perdr\u00e0 l\u2019import de les arres, mentre que, si \u00e9s el venedor qui decideix retirar-se de la venda, haur\u00e0 de\u00a0retornar el doble de l\u2019import\u00a0al comprador.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>5. Obtenci\u00f3 del N\u00famero d\u2019Identificaci\u00f3 d\u2019Estranger (NIE)<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c9s obligatori que els estrangers que compren propietats a Espanya obtinguin un&nbsp;N\u00famero d\u2019Identificaci\u00f3 d\u2019Estranger (NIE). Aquest n\u00famero, que posteriorment es correspondr\u00e0 amb el n\u00famero d\u2019identificaci\u00f3 fiscal, \u00e9s necessari per a totes les transaccions financeres i legals a Espanya i, per tant, tamb\u00e9 per obrir un compte corrent a Espanya.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Es pot sol\u00b7licitar a:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Una comissaria de la&nbsp;Policia Nacional&nbsp;a Espanya.<\/li>\n\n\n\n<li>L\u2019ambaixada o consolat d\u2019Espanya&nbsp;al pa\u00eds de resid\u00e8ncia.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>6. Obertura d\u2019un compte bancari a Espanya<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Per facilitar el pagament de l\u2019immoble i altres despeses relacionades, \u00e9s recomanable que el comprador obri un\u00a0compte bancari a Espanya. Aquest compte s\u2019utilitzar\u00e0 per transferir els fons necessaris per a la compra i per pagar els impostos i taxes associats a l\u2019immoble. Aquest aspecte no \u00e9s secundari. Molt sovint, els compradors estrangers pregunten si poden transferir els fons per a la compravenda directament des del seu banc a l\u2019estranger. L\u2019operaci\u00f3 en si \u00e9s perfectament l\u00edcita; el problema rau en les\u00a0garanties de pagament\u00a0del venedor, que, fins que no hagi rebut els fons al seu compte corrent, no estar\u00e0 disposat a transmetre formalment la propietat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">D\u2019altra banda, el possible comprador tampoc no estar\u00e0 conforme a enviar els fons al venedor abans que se signi l\u2019escriptura de compravenda. Per tant, per superar aquest\u00a0imp\u00e0s, la millor soluci\u00f3 \u00e9s efectuar el pagament mitjan\u00e7ant\u00a0xec bancari\u00a0em\u00e8s per un banc a Espanya o b\u00e9 fer una\u00a0transfer\u00e8ncia via Banc d\u2019Espanya, que, en teoria, permet que els fons arribin en pocs minuts. Una altra soluci\u00f3 \u00e9s utilitzar un\u00a0compte de dip\u00f2sit del notari, que s\u2019encarregar\u00e0 de transferir els fons al venedor nom\u00e9s un cop atorgada l\u2019escriptura de compravenda. Tanmateix, no es tracta d\u2019una operativa gaire habitual i molts notaris prefereixen no assumir aquesta responsabilitat addicional.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>7. Atorgament de l\u2019escriptura p\u00fablica davant notari<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Un dels darrers passos en el proc\u00e9s de compra \u00e9s la signatura de l\u2019escriptura p\u00fablica de compravenda\u00a0davant d\u2019un\u00a0notari espanyol. El notari revisar\u00e0 tota la documentaci\u00f3 i verificar\u00e0 que tot estigui en ordre abans de procedir a la signatura. L\u2019escriptura de compravenda tamb\u00e9 representar\u00e0 el\u00a0t\u00edtol per transmetre la propietat\u00a0del venedor al comprador. El comprador t\u00e9 dret a\u00a0escollir un notari de la seva confian\u00e7a.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>8. Registre de la Propietat<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Despr\u00e9s de la signatura de l\u2019escriptura p\u00fablica, cal inscriure el canvi de titularitat al&nbsp;Registre de la Propietatcorresponent. Com a regla general, si el venedor \u00e9s una empresa o un professional i es tracta de la\u00a0primera transmissi\u00f3\u00a0de l\u2019immoble, la venda estar\u00e0 subjecta a\u00a0IVA\u00a0i a l\u2019impost d\u2019actes jur\u00eddics documentats (AJD). Si l\u2019immoble \u00e9s de\u00a0segona m\u00e0, la venda estar\u00e0 subjecta \u00fanicament a\u00a0ITP.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L\u2019<strong>IVA<\/strong>\u00a0actualment \u00e9s del\u00a0<strong>10 %<\/strong>\u00a0del preu de l\u2019immoble.<\/li>\n\n\n\n<li>L\u2019<strong>impost d\u2019actes jur\u00eddics documentats (AJD)<\/strong>\u00a0pot variar d\u2019una Comunitat a una altra (per exemple, a\u00a0<strong>Catalunya<\/strong>\u00e9s actualment de l\u2019<strong>1,5 %<\/strong>\u00a0del preu de l\u2019immoble).<\/li>\n\n\n\n<li>L\u2019<strong>ITP<\/strong>\u00a0tamb\u00e9 pot variar d\u2019una Comunitat a una altra (generalment es troba entre el\u00a0<strong>8 % i el 10 %<\/strong>\u00a0del preu de l\u2019immoble).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Tots aquests impostos han de ser&nbsp;<strong>pagats pel comprador<\/strong>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">2. <strong>Impostos despr\u00e9s de comprar un immoble a Espanya<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Un cop el comprador \u00e9s propietari, ha de tenir en compte:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Impost Municipal (IBI \u2013 Impost sobre B\u00e9ns Immobles)<\/strong>. \u00c9s un impost anual basat en el valor cadastral de l\u2019immoble. Cada Ajuntament fixa el percentatge de l\u2019impost.<\/li>\n\n\n\n<li><strong>Impost sobre la Renda de no Residents (IRNR)<\/strong>. Com a no resident, si l\u2019immoble es lloga, el propietari ha de pagar impostos sobre l\u2019import del lloguer (<strong>24 %<\/strong>\u00a0si no es resideix a la UE;\u00a0<strong>19 %<\/strong>\u00a0si es resideix a la UE) i ha de presentar una declaraci\u00f3 d\u2019impostos anualment durant els\u00a0<strong>primers 20 dies de gener<\/strong>. Si l\u2019immoble no es lloga, el propietari tamb\u00e9 ha de pagar l\u2019impost sobre la renda cada any. En aquest cas, l\u2019impost es calcula com un determinat percentatge sobre el valor cadastral (generalment el\u00a0<strong>2 %<\/strong>).<\/li>\n\n\n\n<li><strong>Impost sobre la Renda de no Residents (IRNR) en cas de guany patrimonial<\/strong>. Quan l\u2019immoble es ven, tamb\u00e9 s\u2019ha de pagar l\u2019IRNR calculat sobre la difer\u00e8ncia positiva entre el preu de venda i el cost d\u2019adquisici\u00f3. En el cas de no residents a Espanya, el percentatge aplicable sobre el guany ser\u00e0 el mateix que s\u2019ha indicat en el punt anterior.<\/li>\n\n\n\n<li><strong>Impost sobre el Patrimoni<\/strong>. Els subjectes passius s\u00f3n \u00fanicament les persones f\u00edsiques, tot i que tamb\u00e9 hi estar\u00e0 subjecta la persona no resident que tingui a Espanya una participaci\u00f3 en una entitat l\u2019actiu de la qual estigui constitu\u00eft almenys en un\u00a0<strong>50 % per b\u00e9ns immobles<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">La imposici\u00f3 pot variar d\u2019una Comunitat a una altra. Per exemple, a\u00a0Catalunya\u00a0hi ha una\u00a0exempci\u00f3 fins a 500.000,00 euros\u00a0de valor i el tipus impositiu \u00e9s\u00a0progressiu\u00a0(per exemple,\u00a00,210 %\u00a0sobre els primers\u00a0167.129,45 euros;\u00a00,315 %sobre els seg\u00fcents\u00a0167.129,45 euros\u00a0addicionals).<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><em>El nostre despatx t\u00e9 una \u00e0mplia experi\u00e8ncia en assessorar i acompanyar persones no residents en la compravenda d\u2019un immoble.
