{"id":12225,"date":"2026-03-17T16:42:15","date_gmt":"2026-03-17T15:42:15","guid":{"rendered":"https:\/\/maluquerabogados.com\/publicaciones\/arrendamientos-de-temporada-en-cataluna-nueva-regulacion\/"},"modified":"2026-03-27T12:53:53","modified_gmt":"2026-03-27T11:53:53","slug":"arrendaments-de-temporada-a-catalunya-nova-regulacio","status":"publish","type":"post","link":"https:\/\/maluquerabogados.com\/ca\/publicaciones\/arrendaments-de-temporada-a-catalunya-nova-regulacio\/","title":{"rendered":"La nova regulaci\u00f3 dels arrendaments de temporada i habitacions a Catalunya"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">L\u20191 de gener de 2026 va entrar en vigor la <a href=\"https:\/\/portaldogc.gencat.cat\/utilsEADOP\/PDF\/9574\/2127794.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Llei 11\/2025, de 29 de desembre<\/a>, de mesures en mat\u00e8ria d\u2019habitatge i urbanisme, que introdueix canvis significatius en el r\u00e8gim del lloguer a Catalunya. Aquesta normativa modifica la <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2007-20555\" target=\"_blank\" rel=\"noreferrer noopener\">Llei 18\/2007, de 28 de desembre<\/a>, del dret a l\u2019habitatge, i afecta directament propietaris, inquilins i grans tenidors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La reforma t\u00e9 dos objectius principals: delimitar amb m\u00e9s precisi\u00f3 l\u2019encaix dels arrendaments temporals dins del marc del lloguer d\u2019habitatge i refor\u00e7ar els mecanismes de control sobre el mercat, especialment en<a href=\"https:\/\/maluquerabogados.com\/publicaciones\/zonas-tensionadas-criterio-juridico-ante-las-dos-declaraciones\/\" target=\"_blank\" rel=\"noreferrer noopener\"> zones de mercat residencial tensionat.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En aquest article analitzem les principals novetats que introdueix aquesta llei i les seves implicacions pr\u00e0ctiques.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-64a66e0c193591c43bd1f6b826bad954\" style=\"color:#0f0075\"><strong><strong>Qu\u00e8 \u00e9s un arrendament de temporada segons la nova llei?<\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La Llei 11\/2025 estableix que un arrendament de temporada \u00e9s aquell que cobreix la satisfacci\u00f3 de la necessitat d\u2019habitatge de les persones amb car\u00e0cter transitori. Aquest concepte \u00e9s m\u00e9s ampli del que podria semblar, i es refereix a contractes subscrits per raons:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Professionals o laborals<\/li>\n\n\n\n<li>D\u2019estudis<\/li>\n\n\n\n<li>D\u2019atenci\u00f3 o assist\u00e8ncia m\u00e8dica<\/li>\n\n\n\n<li>De situacions provisionals (espera d\u2019entrega d\u2019habitatge, retorn a resid\u00e8ncia habitual)<\/li>\n\n\n\n<li>Altres usos an\u00e0legs<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019element clau \u00e9s que aquests arrendaments satisfan una necessitat d\u2019habitatge, encara que sigui temporal. Aqu\u00ed rau la principal difer\u00e8ncia amb els contractes vacacionals.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">L\u2019excepci\u00f3: lloguers vacacionals<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">La llei exclou expressament d\u2019aquesta categoria els arrendaments amb finalitat exclusivament recreativa, de vacances o d\u2019oci. Aquests contractes es regeixen per les normes d\u2019arrendament per a \u00fas diferent del d\u2019habitatge de la <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1994-26003\" target=\"_blank\" rel=\"noreferrer noopener\">Llei d\u2019Arrendaments Urbans (LAU).<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En aquests casos, ha de constar en el contracte tant la finalitat vacacional com el lloc de resid\u00e8ncia permanent de l\u2019arrendatari.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized has-custom-border\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/maluquerabogados.com\/wp-content\/uploads\/2026\/03\/pexels-artbovich-5998138-1024x683.jpg\" alt=\"arrendaments de temporada\n\" class=\"has-border-color has-white-border-color wp-image-12221\" style=\"border-width:28px;aspect-ratio:1.4992888417882142;width:574px;height:auto\" srcset=\"https:\/\/maluquerabogados.com\/wp-content\/uploads\/2026\/03\/pexels-artbovich-5998138-1024x683.jpg 1024w, https:\/\/maluquerabogados.com\/wp-content\/uploads\/2026\/03\/pexels-artbovich-5998138-300x200.jpg 300w, https:\/\/maluquerabogados.com\/wp-content\/uploads\/2026\/03\/pexels-artbovich-5998138-768x513.jpg 768w, https:\/\/maluquerabogados.com\/wp-content\/uploads\/2026\/03\/pexels-artbovich-5998138-1536x1025.jpg 1536w, https:\/\/maluquerabogados.com\/wp-content\/uploads\/2026\/03\/pexels-artbovich-5998138-2048x1367.jpg 2048w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n<\/div>\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-eac39352ebcedafd5db7a7fe2723f9f0\" style=\"color:#0f0075\"><strong><strong><strong>Obligaci\u00f3 de justificar i acreditar la temporalitat<\/strong><\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Una de les novetats m\u00e9s rellevants de la llei \u00e9s l\u2019obligaci\u00f3 de justificar documentalment el motiu de l\u2019arrendament temporal. Aquesta justificaci\u00f3 ha de:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Constar expressament en el contracte<\/li>\n\n\n\n<li>Acreditar-se mitjan\u00e7ant documentaci\u00f3 espec\u00edfica (certificat d\u2019empresa, matr\u00edcula universit\u00e0ria, informe m\u00e8dic, etc.)<\/li>\n\n\n\n<li>Dipositar, juntament amb la fian\u00e7a en el registre corresponent, la documentaci\u00f3 que acrediti la causa de la temporalitat del contracte<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">La conseq\u00fc\u00e8ncia de no acreditar correctament la temporalitat \u00e9s clara: el contracte podr\u00e0 ser considerat com un arrendament d\u2019habitatge habitual, amb aplicaci\u00f3 del r\u00e8gim previst per a aquest tipus de contractes a la Llei d\u2019Arrendaments Urbans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En aquest sentit, cal tenir en compte que la durada del contracte d\u2019arrendament pot ser la que acordin lliurement les parts. No obstant aix\u00f2, quan aquesta durada sigui inferior a cinc anys \u2014o inferior a set anys si l\u2019arrendador \u00e9s una persona jur\u00eddica\u2014, el contracte es prorrogar\u00e0 obligat\u00f2riament per terminis anuals fins a assolir aquesta durada m\u00ednima, llevat que l\u2019arrendatari manifesti a l\u2019arrendador, amb almenys trenta dies d\u2019antelaci\u00f3 a la data de finalitzaci\u00f3 del contracte o de qualsevol de les seves pr\u00f2rrogues, la seva voluntat de no renovar-lo. Aix\u00ed ho estableix <a href=\"https:\/\/www.conceptosjuridicos.com\/articulos\/ley-arrendamientos-urbanos-articulo-10\/\" target=\"_blank\" rel=\"noreferrer noopener\">l\u2019article 10.1 de la Llei d\u2019Arrendaments Urbans (LAU).<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-39eda6e765fc633feac68b376505310e\" style=\"color:#0f0075\"><strong>A<strong><strong><strong>plicaci\u00f3 de l\u00edmits de renda en zones tensionades<\/strong><\/strong><\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Una de les novetats m\u00e9s significatives \u00e9s que els arrendaments temporals (excepte els vacacionals, \u00e9s a dir, amb finalitat exclusivament recreativa, de vacances o d\u2019oci) queden subjectes a les mateixes normes que els arrendaments d\u2019habitatge habitual pel que fa a:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Determinaci\u00f3 de la renda inicial<\/li>\n\n\n\n<li>Actualitzaci\u00f3 de la renda<\/li>\n\n\n\n<li>Increment de la renda per millores<\/li>\n\n\n\n<li>Fian\u00e7a i garanties addicionals<\/li>\n\n\n\n<li>Assumpci\u00f3 de despeses generals i serveis individuals<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Aix\u00f2 implica que, en <a href=\"https:\/\/maluquerabogados.com\/publicaciones\/zonas-tensionadas-criterio-juridico-ante-las-dos-declaraciones\/\" target=\"_blank\" rel=\"noreferrer noopener\">zones de mercat residencial tensionat,<\/a> els arrendaments temporals han de respectar els mateixos l\u00edmits de contenci\u00f3 de rendes que la resta de contractes d\u2019habitatge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En la pr\u00e0ctica, aix\u00f2 suposa que tamb\u00e9 s\u2019ha d\u2019aplicar l\u2019\u00cdndex de preus de refer\u00e8ncia del lloguer, que serveix com a criteri per determinar la renda m\u00e0xima aplicable en aquestes zones.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-bf13fbe19771fc1d2025e5e7c987b03f\" style=\"color:#0f0075\"><strong><strong><strong><strong><strong>Prohibici\u00f3 de l\u2019encadenament de contractes temporals<\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La llei introdueix mecanismes espec\u00edfics per evitar l\u2019\u00fas abusiu de contractes temporals successius. Es distingeixen dos sup\u00f2sits:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">En cas de pr\u00f2rroga del contracte<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019arrendatari ha d\u2019acreditar que:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La causa temporal persisteix<\/li>\n\n\n\n<li>Mant\u00e9 la seva resid\u00e8ncia habitual en un altre lloc<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Si no pot acreditar-ho, el contracte es convertir\u00e0 autom\u00e0ticament en arrendament d\u2019habitatge habitual des de la data del contracte inicial, amb aplicaci\u00f3 del termini abans indicat de 5 o 7 anys, i el sistema de <a href=\"https:\/\/maluquerabogados.com\/ca\/publicaciones\/prorroga-legal-prorroga-tacita-i-tacita-reconduccio\/\" target=\"_blank\" rel=\"noreferrer noopener\">pr\u00f2rrogues corresponents.<\/a><\/p>\n\n\n\n<h4 class=\"wp-block-heading\">En cas de nou contracte entre les mateixes parts<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Si, un cop finalitzat el contracte temporal, se\u2019n signa un de nou entre les mateixes parts i per al mateix habitatge, aquest nou contracte quedar\u00e0 sotm\u00e8s al r\u00e8gim d\u2019arrendament d\u2019habitatge permanent, llevat que s\u2019acrediti degudament la persist\u00e8ncia de les circumst\u00e0ncies que justificaven la necessitat temporal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aquesta mesura busca impedir la pr\u00e0ctica de renovar contractes temporals indefinidament sense causa real.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"wp-block-heading has-text-color has-link-color wp-elements-ede9f390781215345ccc1655ea370c53\" style=\"color:#0f0075\"><strong><strong><strong><strong><strong><strong>L\u2019arrendament d\u2019habitacions: nova regulaci\u00f3 espec\u00edfica<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La<a href=\"https:\/\/www.boe.es\/ccaa\/dogc\/2025\/9574\/f00001-00025.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"> Llei 11\/2025<\/a> introdueix per primera vegada una regulaci\u00f3 espec\u00edfica de l\u2019arrendament d\u2019habitacions a Catalunya, configurant-lo com aquell contracte pel qual s\u2019atribueix a l\u2019arrendatari:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L\u2019\u00fas exclusiu d\u2019una habitaci\u00f3 a l\u2019habitatge<\/li>\n\n\n\n<li>El dret a utilitzar altres estances o espais d\u2019\u00fas com\u00fa<\/li>\n\n\n\n<li>A canvi d\u2019un preu<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Requisits d\u2019habitabilitat<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Els arrendaments d\u2019habitacions han de complir amb les condicions d\u2019habitabilitat establertes per la normativa sectorial, en particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Est\u00e0ndards de superf\u00edcie m\u00ednima per persona<\/li>\n\n\n\n<li>Llindar m\u00e0xim d\u2019ocupaci\u00f3<\/li>\n\n\n\n<li>Requisits reflectits en la c\u00e8dula d\u2019habitabilitat<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">La llei estableix expressament que l\u2019arrendament per habitacions no desnaturalitza el car\u00e0cter d\u2019arrendament d\u2019habitatge ni exclou l\u2019aplicaci\u00f3 de les seves normes protectores.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">L\u00edmit espec\u00edfic de renda en zones tensionades<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">En les<a href=\"https:\/\/maluquerabogados.com\/ca\/publicaciones\/zones-tensionades-catalunya-interpretacio-juridica\/\" target=\"_blank\" rel=\"noreferrer noopener\"> zones de mercat residencial tensionat<\/a>, s\u2019estableix un l\u00edmit espec\u00edfic per al lloguer d\u2019habitacions:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Quan existeixin diversos contractes d\u2019arrendament d\u2019habitacions vigents de forma simult\u00e0nia en un mateix habitatge, la suma de totes les rendes pactades no pot superar la renda m\u00e0xima que resultaria aplicable si l\u2019habitatge es llogu\u00e9s de manera unit\u00e0ria.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aquesta norma evita que es fragmenti el lloguer d\u2019un habitatge per eludir els topalls de renda establerts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-42d2efd4827d0a74a2b8355d3b110796\" style=\"color:#0f0075\"><strong><strong><strong><strong><strong><strong><strong>Grans tenidors: ampliaci\u00f3 del dret de tanteig i retracte<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La llei amplia significativament el dret de tanteig i retracte de la Generalitat de Catalunya sobre les transmissions d\u2019habitatges.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">\u00c0mbit d\u2019aplicaci\u00f3<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Aquest dret s\u2019aplica a les transmissions de qualsevol habitatge situat en zones declarades de mercat residencial tensionat quan sigui propietat d\u2019un <a href=\"https:\/\/maluquerabogados.com\/ca\/publicaciones\/gran-tenidor-a-catalunya-i-zones-tensades-claus-del-lloguer\/\" target=\"_blank\" rel=\"noreferrer noopener\">gran tenidor persona jur\u00eddica<\/a> inscrit.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Excepcions al dret de tanteig i retracte<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">El dret de tanteig i retracte no s\u2019aplica en:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Transmissions d\u2019habitatges de nova construcci\u00f3 o gran rehabilitaci\u00f3 realitzades dins de l\u2019any seg\u00fcent a l\u2019obtenci\u00f3 de la c\u00e8dula d\u2019habitabilitat<\/li>\n\n\n\n<li>Primeres transmissions d\u2019obra nova entre societats del mateix grup que tinguin el mateix objecte social o activitat immobili\u00e0ria similar<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Qualificaci\u00f3 permanent com a VPO<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Els habitatges adquirits per la Generalitat mitjan\u00e7ant l\u2019exercici del dret de tanteig i retracte hauran de qualificar-se de manera permanent com a habitatges de protecci\u00f3 oficial de r\u00e8gim general.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aquesta mesura pret\u00e9n mobilitzar habitatge destinant-lo al parc p\u00fablic de manera estable.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-69b257152b5358497a31a421fe513318\" style=\"color:#0f0075\"><strong><strong><strong><strong><strong><strong><strong><strong>Registre de grans tenidors d\u2019habitatge<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La llei crea el Registre de Grans Tenidors d\u2019Habitatge, de car\u00e0cter obligatori per a aquells que compleixin els requisits establerts.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Obligaci\u00f3 transit\u00f2ria<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Mentre no entri en vigor la normativa que reguli formalment el Registre, les persones jur\u00eddiques que vulguin transmetre habitatges situats en una zona de mercat residencial tensionat hauran de declarar si s\u00f3n grans tenidors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Si manifesten que no s\u00f3n grans tenidors, hauran d\u2019aportar un certificat registral que acrediti el nombre d\u2019habitatges de la seva propietat en el moment d\u2019atorgar l\u2019escriptura de compravenda.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Reducci\u00f3 de la vig\u00e8ncia de la inscripci\u00f3 en el Registre de sol\u00b7licitants de VPO<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">La llei redueix la vig\u00e8ncia de la inscripci\u00f3 en el Registre de sol\u00b7licitants d\u2019habitatge de protecci\u00f3 oficial a dos anys, llevat de renovaci\u00f3.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-0057c5687380a5094d8c6f5f9788364a\" style=\"color:#0f0075\"><strong><strong><strong><strong><strong><strong><strong><strong><strong>Comissi\u00f3 de supervisi\u00f3 de contractes d\u2019arrendament<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Es crea la Comissi\u00f3 de Supervisi\u00f3 de Contractes d\u2019Arrendament d\u2019Habitatge, amb funcions de:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Supervisi\u00f3 del mercat del lloguer<\/li>\n\n\n\n<li>Control especial de plataformes digitals d\u2019intermediaci\u00f3<\/li>\n\n\n\n<li>Vigil\u00e0ncia del compliment de la normativa<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Aquest organisme refor\u00e7a els instruments de control i disciplina del mercat.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized has-custom-border\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\"
