On the one hand, the declaration of&nbsp;<em>tensioned residential market areas<\/em>&nbsp;has introduced&nbsp;<strong>limits on rental prices<\/strong>&nbsp;in municipalities where access to housing has become particularly difficult. On the other hand, the Generalitat of Catalonia has redefined the concept of the&nbsp;<strong>large property owner<\/strong>, expanding their obligations and creating a specific registry to identify these owners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both concepts (<a href=\"https:\/\/maluquerabogados.com\/en\/publicaciones\/stressed-housing-areas-in-catalonia-legal-interpretation\/\" target=\"_blank\" rel=\"noreferrer noopener\">tensioned residential market areas <\/a>and large property owners) are closely linked and are essential to understanding the new housing framework in Catalonia.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-8bc7fc46070618fbfa81eb304cf78ef5\" style=\"color:#0e2f95\">What does it mean to be a &#8220;Large Property Owner&#8221;? <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Generalitat of Catalonia defines a&nbsp;large property owner&nbsp;as any individual or legal entity that owns a certain number of dwellings or a built residential surface area exceeding the limits established by current regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>In general, a person is considered a large property owner in Catalonia if they own:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Five or more dwellings<\/strong>&nbsp;located in municipalities declared as tensioned residential market areas.<\/li>\n\n\n\n<li><strong>More than 10 dwellings<\/strong>&nbsp;located in Spanish territory, provided that at least one of them is located within a tensioned area in Catalonia.<\/li>\n\n\n\n<li><strong>More than 1,500 m\u00b2 of built residential surface area<\/strong>, regardless of the ownership share in each property, if any of them is located in a municipality declared as tensioned.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Difference Between Tensioned and Non-Tensioned Areas<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The regulations distinguish between municipalities declared as&nbsp;<strong>tensioned areas<\/strong>&nbsp;and those that are not, as the thresholds differ.<\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\" style=\"padding-top:0;padding-right:var(--wp--preset--spacing--40);padding-bottom:0;padding-left:var(--wp--preset--spacing--40)\"><table class=\"has-fixed-layout\" style=\"border-width:32px\"><tbody><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>NON-TENSIONED AREAS<\/strong><\/td><td><strong>TENSIONED AREAS<\/strong><\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\">A person is considered a large property owner if they own:<br>&#8211; <strong>11 or more dwellings<\/strong>, <br><strong>&#8211;<\/strong> <strong>More than 1,500 m\u00b2 of built residential surface area<\/strong>.<br><br>If a person is a co-owner of a dwelling, how is the number of dwellings calculated?<br><strong>&#8211;<\/strong> <strong>If they own&nbsp;more than 50%<\/strong>&nbsp;of a dwelling, it counts as&nbsp;<strong>one dwelling<\/strong>.<br>&#8211; If they own&nbsp;<strong>50% or less<\/strong>&nbsp;of different dwellings, the&nbsp;<strong>sum of the ownership shares<\/strong>&nbsp;must exceed&nbsp;<strong>1,500 m\u00b2 of built residential surface area<\/strong>.<br>&#8211; If they are the&nbsp;<strong>sole owner of some dwellings and a co-owner of others<\/strong>, the&nbsp;<strong>sum of the built surface areas of all dwellings<\/strong>&nbsp;must exceed&nbsp;<strong>1,500 m\u00b2<\/strong>, regardless of the ownership percentage in each.<\/td><td>The threshold is reduced, and a person is considered a large property owner if they own:<br>&#8211; <strong>Five or more dwellings<\/strong>.<br><br><strong>If a person is a co-owner of a dwelling, how is the number of dwellings calculated?<\/strong><br>&#8211; If a person owns&nbsp;<strong>more than 50%<\/strong>&nbsp;of a dwelling, it is counted as&nbsp;<strong>one full dwelling<\/strong>.<br>&#8211; If they own&nbsp;<strong>50% or less<\/strong>&nbsp;of several dwellings, the&nbsp;<strong>sum of their ownership shares must be equivalent to five full dwellings<\/strong>.<br><br>Dwellings located in&nbsp;<strong>different tensioned areas are not accumulated<\/strong>. For example, if a person owns four dwellings in one area and one in another, they are not considered a large property owner.<br>The&nbsp;<strong>habitual and permanent residence<\/strong>&nbsp;of the owner is&nbsp;<strong>not included<\/strong>&nbsp;in the calculation.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-d7e357d22bac164ea318eb5b552a2fba\" style=\"color:#0e2f95\">Which Dwellings Are Counted<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To determine whether a person or entity is considered a&nbsp;<strong>large property owner<\/strong>,&nbsp;<strong>residential-use properties<\/strong>&nbsp;owned either in full ownership or under a usufruct right are taken into account, in accordance with&nbsp;<strong><a href=\"http:\/\/To determine whether a person or entity is considered a large property owner, residential-use properties owned either in full ownership or under a usufruct right are taken into account, in accordance with Law 12\/2023, of 24 May, on the right to housing, which expressly excludes garages and storage rooms. class=\"wp-block-paragraph\">Several ownership scenarios are distinguished:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Bare ownership:<\/strong>&nbsp;Bare ownership titles are&nbsp;<strong>not counted<\/strong>, as the holder lacks the right of use and enjoyment of the property.<\/li>\n\n\n\n<li><strong>Usufruct:<\/strong>&nbsp;Usufruct rights&nbsp;<strong>are counted<\/strong>, as they grant the right of use and benefit of the property.<\/li>\n\n\n\n<li><strong>Shared ownership or communities of property:<\/strong>&nbsp;If one co-owner or member of a community of property is considered a large property owner and others are not,&nbsp;<strong>this condition prevails<\/strong>, and the property is subject to the rent limitation regime applicable to large property owners.<\/li>\n\n\n\n<li><strong>Buildings under vertical ownership:<\/strong>&nbsp;<strong>All residential units<\/strong>&nbsp;into which the building is physically divided are counted, whether or not they are individually registered in the Property Registry.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">All residential dwellings are included, regardless of whether they are rented, vacant or under renovation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Included:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Dwellings under direct ownership.<\/li>\n\n\n\n<li>Dwellings under shared ownership with other owners (in proportion to the undivided share).<\/li>\n\n\n\n<li>Rented dwellings, occupied or vacant.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Excluded:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The habitual residence.<\/li>\n\n\n\n<li>Garages, storage rooms or commercial premises.<\/li>\n\n\n\n<li>Protected housing (public or subsidised housing).<\/li>\n\n\n\n<li>Dwellings located outside Spanish territory.<\/li>\n\n\n\n<li>Tourist accommodation or dwellings with uses other than habitual residential use.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-b027b4ad3fa3d091a9997c26a1b36aef\" style=\"color:#0e2f95\"><strong>What is a Tensioned Residential Market Area?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A&nbsp;<strong>Tensioned Residential Market Area<\/strong>&nbsp;is a geographical area or municipality where housing costs (purchase or rental) have increased beyond what is reasonable in relation to the average income of the population.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An area is declared \u201ctensioned\u201d when:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Households allocate&nbsp;<strong>more than 30% of their income<\/strong>&nbsp;to rent or mortgage payments, or<\/li>\n\n\n\n<li>Housing prices have increased, over the last five years,&nbsp;<strong>by more than three percentage points above the CPI<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This declaration allows the application of&nbsp;<strong>rental price limits<\/strong>&nbsp;and specific control measures to prevent excessive increases and improve market stability.at.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Affected Municipalities<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/habitatge.gencat.cat\/ca\/ambits\/preus-ingressos-i-zones\/limit-preu-lloguer\/preguntes-frequents-zmrt\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">Generalitat<\/a> of Catalonia has established tensioned areas in two phases:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2024-5214\" target=\"_blank\" rel=\"noreferrer noopener\">First Phase <\/a>(March 2024):<\/strong> Entered into force on&nbsp;<strong>16 March 2024<\/strong>, affecting&nbsp;<strong>140 Catalan municipalities<\/strong>, including Barcelona, L\u2019Hospitalet de Llobregat, Badalona, Sabadell, Terrassa, Girona, Tarragona and Reus. These municipalities were the first to apply price limits due to the highest market pressure.<\/li>\n\n\n\n<li><strong><a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2024-20576\" target=\"_blank\" rel=\"noreferrer noopener\">Second Phase<\/a> (October 2024):<\/strong> On&nbsp;<strong>10 October 2024<\/strong>,&nbsp;<strong>131 additional municipalities<\/strong>&nbsp;were included, bringing the total to&nbsp;<strong>271 municipalities<\/strong>&nbsp;across Catalonia. This phase extended regulation to areas where rental prices had risen steadily, especially in coastal municipalities and inland areas with strong residential demand.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">As a result,&nbsp;<strong>more than 80% of the Catalan population<\/strong>&nbsp;currently lives in a declared tensioned area.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"736\" src=\"https:\/\/maluquerabogados.com\/wp-content\/uploads\/2025\/12\/Captura-de-pantalla-2025-12-16-a-las-11.19.55-1024x736.png\" alt=\"Large property owner\" class=\"wp-image-11574\" style=\"width:566px;height:auto\" srcset=\"https:\/\/maluquerabogados.com\/wp-content\/uploads\/2025\/12\/Captura-de-pantalla-2025-12-16-a-las-11.19.55-1024x736.png 1024w, https:\/\/maluquerabogados.com\/wp-content\/uploads\/2025\/12\/Captura-de-pantalla-2025-12-16-a-las-11.19.55-300x216.png 300w, https:\/\/maluquerabogados.com\/wp-content\/uploads\/2025\/12\/Captura-de-pantalla-2025-12-16-a-las-11.19.55-768x552.png 768w, https:\/\/maluquerabogados.com\/wp-content\/uploads\/2025\/12\/Captura-de-pantalla-2025-12-16-a-las-11.19.55.png 1386w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n<\/div>\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-d4a715954c37bde34da0f6da5a60f812\" style=\"color:#0e2f95\"><strong>Effects on rental agreements<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Lease agreements signed in municipalities declared as tensioned residential market areas must comply with a&nbsp;<strong>maximum price<\/strong>&nbsp;set by the&nbsp;<strong>Rental Price Reference Index<\/strong>, developed by the Generalitat of Catalonia based on:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Surface area<\/li>\n\n\n\n<li>Location<\/li>\n\n\n\n<li>Year of construction<\/li>\n\n\n\n<li>Property characteristics<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The&nbsp;<strong>maximum rental price<\/strong>&nbsp;in tensioned areas depends on whether the landlord is a large property owner.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the landlord&nbsp;<strong>is a large property owner<\/strong>, the rent must be the&nbsp;<strong>lower<\/strong>&nbsp;of the following two amounts:\n<ul class=\"wp-block-list\">\n<li>The price set by the rental price reference index.<\/li>\n\n\n\n<li>The updated rent from the previous contract, if the dwelling has been rented within the last five years.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the previous rent is&nbsp;<strong>higher<\/strong>&nbsp;than the index, the rent set by the&nbsp;<strong>reference index must be applied<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the dwelling&nbsp;<strong>has not had a rental contract in the last five years<\/strong>, the rent will be determined&nbsp;<strong>exclusively<\/strong>&nbsp;according to the reference index.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the landlord&nbsp;<strong>is not a large property owner<\/strong>, the rent must be set according to the&nbsp;<strong>previous contract rent<\/strong>&nbsp;in force during the last five years.<\/li>\n\n\n\n<li>If the reference index sets a lower rent, the landlord may&nbsp;<strong>voluntarily (not obligatorily)<\/strong>&nbsp;choose to apply the index price.<\/li>\n\n\n\n<li>If no rental contract has been in force in the last five years, the price will also be set according to the&nbsp;<strong>reference index<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The price range established by the reference index can be consulted on the&nbsp;<strong>official State platform<\/strong>, through the&nbsp;<a href=\"https:\/\/serpavi.mivau.gob.es\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Rental Price Reference Index<\/strong>.<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-3a9ee9d2732a3acb030bec53e1e352a6\" style=\"color:#0e2f95\"><strong><strong>Obligation to register in the large property owners registry of Catalonia<\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Large property owners are required to register in the&nbsp;<a href=\"https:\/\/web.gencat.cat\/ca\/tramits\/tramits-temes\/Comunicacio-de-la-condicio-de-gran-tenidor-dhabitatge\" target=\"_blank\" rel=\"noreferrer noopener\">Large Property Owners Registry of the Generalitat of Catalonia<\/a>, indicating the total number of dwellings they own, including those corresponding to them as members of communities of property. Failure to comply constitutes an&nbsp;administrative offence, punishable by fines ranging&nbsp;from \u20ac9,001 to \u20ac90,000, depending on the severity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Currently, the regulation formally governing registration&nbsp;has not yet been approved. Until it enters into force, large property owners must&nbsp;notify the Catalan Housing Agency&nbsp;of their status, also indicating the number of dwellings they own.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once the regulation is approved, it will be mandatory to&nbsp;apply for registration&nbsp;in accordance with&nbsp;Additional Provision 27 of Law 18\/2007, of 28 September, on the right to housing.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-9ea878aabedd31a2bbd94e5f9bb110b4\" style=\"color:#0e2f95\"><strong>In summary<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Catalonia is experiencing a profound shift in housing policy.
